Nous sommes donc dans un cas de figure qui n'entre absolument pas dans le cadre du débat en cours sur l'euthanasie, c'est-à-dire la possibilité de mettre fin à la vie d'une personne qui le demande. Nous sommes plutôt, si l'enquête le confirme, dans un cas d'homicides sur personnes vulnérables. Certes, dans ces affaires, il ne faut pas minimiser les difficultés que peuvent ressentir les soignants face à ces questions de fin de vie. Mais dans le cas présent, ce médecin a, semble-t-il, agi seul, alors que l'on essaie au contraire de mettre en place une approche collégiale et pluriprofessionnelle. C'est tout l'intérêt, à mon avis, de la loi Leonetti sur la fin de vie.

Il faut rappeler que, dans le cadre de la loi actuelle, qui autorise l'arrêt des traitements au risque d'abréger la vie [par abus de langage, "euthanasie passive"], le consentement des patients et de leurs proches est absolu : la décision ne peut être prise qu'au terme d'une discussion avec les médecins et les proches, procédure collégiale dont il doit exister une trace écrite dans le dossier du patient. C'est aussi après une telle discussion que l'on décide de mettre en place une sédation quand la personne souffre trop – ce qui lui permettra d'accéder à sa propre mort plus tranquillement.
Cette affaire peut-elle faire avancer le débat sur l'euthanasie ?
Pour avancer dans cette discussion, il faut être clair sur le plan sémantique, distinguer ce qui fait débat ou non. Ce qui fait débat, c'est la question de savoir si l'on ouvre la possibilité de mettre fin à la vie d'une personne qui le demande – c'est un débat sur la liberté ou non de choisir sa mort. Ce qui ne fait pas débat, c'est le fait de décider à la place d'autrui de sa propre mort, et surtout pour des personnes en situation de grande vulnérabilité.
Autant le premier débat est légitime et doit être nourri, en dehors des affaires médiatiques, par des études et des réflexions approfondies – c'est justement la mission de l'Observatoire national de la fin de vie. Autant le second ne me paraît absolument pas légitime dans un Etat démocratique : le jour où l'on s'autoriserait à abréger la vie de personnes qui n'ont rien demandé, au motif qu'elles sont vulnérables, fragiles ou en fin de vie, il me semble que nous aurions beaucoup à craindre pour l'avenir.
