      EPA - NPL Site Narrative for Lehigh Valley Railroad
      LEHIGH VALLEY RAILROAD

      Le Roy, New York

      Federal Register Notice: January 19, 1999

      Conditions at Proposal (July 28, 1998): The Lehigh Valley Railroad site in LeRoy, Genesee County, New York is the location of a chemical spill that resulted from a 1970 train derailment. The site consists of portions of Gulf Road, the former railroad bed, and the properties adjacent to the crossing. The site is in a rural setting, and the surrounding area is used for residential, recreational, and commercial purposes. An intermittent stream, Mud Creek, is located approximately 500 feet to the southeast.

      The derailment occurred at approximately 3:30 a.m. on Sunday, December 6, 1970. Approximately 1 ton of cyanide crystals spilled onto the ground. The cleanup included the removal of the crystals and the overturned car. After the crystals were removed, neutralizers were spread on the ground to counteract the effects of any remaining cyanide. Trichloroethylene (TCE) was also released from two ruptured tank cars. A Genesee County Health Department (GCHD) engineer who was among the first people to respond to the accident and a claims agent for Lehigh Valley Railroad each reported in February 1971 that approximately 35,000 gallons of TCE had been spilled. A geologist hired by Lehigh Valley Railroad to investigate pollution resulting from the spill reported in March 1971 that approximately 30,000 gallons of TCE were spilled. TCE odors were noticed eight days after the derailment in the basement of the Knickerbocker Hotel, which was located 200 feet north of the crossing. Lehigh Valley Railroad tried to alleviate the odors by flushing the chemical out of the surrounding fill sometime between March and June 1971. The response action involved digging trenches near the crossing, pumping approximately 1 million gallons of water from a nearby quarry into the trenches, and allowing the water to percolate into the ground. The owners of two private wells located along Gulf Road east of the site noticed TCE in their water supplies about a week after the spill. Approximately one month later, TCE was noticed in two other wells located more than 0.5 mile southeast of the site. The TCE concentrations for samples collected from the affected wells in 1970 and 1971 ranged from 4 parts per million (ppm) to 171 ppm. By November 1971, seven wells had become contaminated. Lehigh Valley Railroad provided drinking water to residents with contaminated wells beginning in June 1971, and later provided the installation and maintenance of charcoal filtering systems at the affected wells.

      In September 1989, TCE was detected during routine sampling of the Genesee County Campground well located more than 1.5 miles east of the site. Further sampling of private wells by New York State Department of Health (NYSDOH), U.S. Environmental Protection Agency (EPA), and New York State Department of Environmental Conservation (NYSDEC) between 1990 and 1994 detected TCE in approximately 50 wells located east or southeast of the site. In December 1991, EPA began installing granular activated carbon (GAC) water treatment systems at 37 locations where TCE exceeded 5 micrograms per liter (?g/L), the Maximum Contaminant Level (MCL). In October 1994, the NYSDEC installed an additional GAC system at a residence exceeding the MCL.

      NYSDEC completed a Remedial Investigation and Feasibility Study (RI/FS) in 1997 that included a soil gas survey, soil sampling, and a hydrogeologic investigation. The results of soil sampling conducted in September 1992, December 1992, and October 1994 showed TCE concentrations ranging from 46 to 570,000 micrograms per kilogram (µg/kg); total 1,2-DCE concentrations ranging from 40 to 5,200 µg/kg; and cyanide concentrations ranging from 1.7 to 64.8 milligrams per kilogram (mg/kg) in soils collected at the site. The hydrogeologic investigation showed that there is a source of TCE contamination remaining in the unsaturated soil and bedrock at the spill site, and a ground water plume extending almost 4 miles east and southeast of the site. NYSDEC issued a Record of Decision (ROD) for the site in March 1997. NYSDEC selected ex-situ soil vapor extraction and bedrock vapor extraction as source control measures and a water-line extension to provide a safe potable water supply to all affected residents and businesses.

      An observed release to ground water is documented by the chemical analysis of ground water samples collected from private drinking water wells in 1993 and 1994. Level I contamination (with a high of 3,100 ppb) is documented for 15 wells. Level II contamination is also documented for one well. The total population served by private ground water wells within 4 miles of the site is approximately 2,515. The bedrock aquifer is the only significant source of ground water for private wells in the site vicinity. The bedrock aquifer is not used for public supplies within 4 miles of the site. The nearest public supply wells are located in the Village of Caledonia more than 4 miles east of the site.

      Status (January 1999): The remedial design for waterline extension is scheduled for completion in April 1999. Construction of the waterline should begin in July 1999 with completion expected toward the end of 2000. The bedrock vapor extraction system is in the pre-design phase. Pilot studies have been completed and the remedial design is scheduled to start in August 1999. The remedy for the surface soils is excavation and treatment. The remedial design is scheduled to start in August 1999.

        Suspects
        The preliminary report found two potential suspects in the cancers. People who developed glioma had worked with low-level ionizing radiation sources and n-hexane (a solvent not known to cause any form of cancer in humans) more frequently than the control group.

        According to Amoco, there is no causative link between brain cancer and the known types and magnitudes of exposures experienced by the researchers. The company believes n-hexane and ionizing radiation may have played a role with other chemicals to cause the outbreak. The company stopped using n-hexane in experiments when research showed it caused peripheral nervous system damage.

        While company records indicate the individuals experienced less exposure to ionizing radiation in their entire lifetimes than is allowable under current regulations for a single year, further investigation will be conducted to determine the possible sources and specific levels of exposure experienced by the cases.
        The synergy was never officially identified in that case. I wonder if there could be one in that locked up sports field?

            Rockland County Neurologist Examines LeRoy Girls

            Dr. Rosario Trifiletti, a Child Neurologist from Rockland County, examined nine girls and took blood tests
            ?What we saw today [Sunday] was very striking. The common denominator among all the cases was the very abrupt onset of symptoms,? said Trifiletti. ?Every person mentioned they were fine a few minutes or hours before they had a sudden rapid change with these symptoms.?

            The test results should be back in about a week.

                That, Brockovich contended, could explain some of the phenomena that parents report seeing at the school, particularly on the athletic fields.

                "...Family has reported that there's an orange-yellow substance that almost kind of oozes from the ground... that is on the children's clothing, their shoes," Brockovich noted.
                Here is a more recent article about the two girls from Corinth that passed through the town of LeRoy this summer. The father of one girl says he does not know how long they spent in Le Roy, nor what they did when they were there.

                Lori, the other affected girl on the travel softball team who got sick with neurological symptoms after visiting Le Roy, has several videos on Youtube.
                She notes in the text on this one that an adult woman in her town has gotten TS now.

                This is the video my mom made before everyone knew. It is a real issue. Now there is a new individual in our town who started having tourettes, a very reputable adult female and is quite a shocker this is happening to her. I pray she heals as well.
                Since the two Corinth girls are softball players I wish someone were looking into whether or not they visited the athletic fields in Le Roy last summer.

                As far as we know the school did not have soil testing done, and they won't allow anyone other than parties they choose and pay to do testing.

                Ultimately, unraveling the genetic background of tic and related disorders will hopefully lead to a better understanding of environmental factors and more targeted treatment.

                  High school students in the small community of Leroy, New York State, have been coming down with strange tics and verbal outbursts, with no obvious cause.


                  It says that symptoms also include fainting spells.
                  One of the girls now uses a wheelchair as she finds it hard to stand.

                    Doctor Issues Statement About Meeting With LeRoy Teens

                    LEROY, NY -- The doctor who visited with some of the teens from LeRoy experiencing tics and Tourette's-like symptoms issued a statement Monday.

                    Dr. Rosario Trifiletti, a child neurologist from New Jersey, met with some of the girls, after parents sought a second opinion following an initial disgnosis of conversion disorder.

                      Here is the key point from Dr. Trifiletti's statement from the link posted above by Digger -

                      The results of my tests will take 1-2 weeks to return. I will again brief the media after results return and are reviewed with the patients as to my conclusions, but will have no further comment before that time.

                      I have no comment on the potential role of any environmental neurotoxins and did no testing relative to that possibility.

                        LeRoy, N.Y. - On the very day two environmental groups called for more testing in LeRoy, we learned the EPA is testing drums of soil on the site of a 1970's train derailment.

                        The drums contain rocks and soil taken during groundwater testing at the derailment site. It is a Superfund Clean-up site and is located off of Gulf Road, about four miles from the high school.

                        EPA Spokeswoman Mary Mears told us she doubts the material is hazardous but says the EPA agreed to the testing "in response to community concerns."
                        The EPA says the results of tests should be back sometime late next week.

                        The WHEC video states the following:

                          People in the town of LeRoy are wondering if something that happened 40 years ago could have anything to do with what's happening now.

                          Environmental crusader Erin Brockovich first brought it up over the weekend. Her team was in LeRoy searching for the cause of an illness affecting at least 15 high school students and one adult.

                          40 years ago, there was a train derailment that spilled toxic chemicals in LeRoy.

                          The derailment in 1970 dumped a ton of cyanide crystals and thousands of gallons of the chemical commonly known as "TCE". This morning, environmental specialists surveyed the land and numerous barrels that have disintegrated and are leaking contaminated soil and water.

                          Beth Miller is the parents of one of the teens who's developed an illness that causes vocal outbursts and tics. She saw all the testing first-hand today.

                          The EPA, which is heading the clean-up in LeRoy, claims there is no connection, but Miller and others don't buy it.
                          An EPA spokesperson says their presence is just for routine maintenance. The site of the derailment is 4 miles away from the high school. Local residents are hungry for answers since 15 high schoolers developed symptoms that mimic Tourette's syndrome.
                          The EPA crews will be in town for the remainder of the week. There's no word on what, if anything, we'll learn about their tests. Brockovich says it's unlikely TCE is the cause of the tics, but says that residents should be aware the spill has not been adequately addressed.
                          "There's quite a few students sick right now and whether it be from that or from something else, we need to find out what's causing it before more students are affected," says Miller.

                          Obviously we have two conflicting stories here comparing this to the WHAM article referenced in the previous post above. It appears the WHAM article in post #86 may contain the latest updated information on the EPA involvement but the article update times would indicate otherwise.

                            Hydrogeologic and Geospatial Data for the Assessment of Focused Recharge to the Carbonate-Rock Aquifer in Genesee County, New York

                            According to this Geolocial Survey Document, the NYSDOH and the Genesee County Health Department were not only concerned about chemical contamination in aquifers in this area, but also E. coli and nitrate contamination from liquid manure applications that had caused aquifer contamination several times. Per this 2010 USGS document(linked below), the concern for contamination that had occurred was as recent as the Spring of 2010.

                            This is a very enlightning document that contains geological maps of the area surrounding LeRoy details the rock formations, depths of soils and elevations. It does a very great job of describing the reasons for the problem of groundwater and soil contamination in this and other regions of the county. It also discusses the seasonal cycles of surface waters and how they effect the contamination due to surface runoffs entering low areas and sinkholes. This process then creating a situation where surface contamination can rapidly spread for great distances through underground features in the area.

                            Specifically, I note page 7 section "Introduction", paragraph #1 below.

                            New York State Department of Health (NYSDOH) and the Genesee County Health Department have become increasingly concerned about chemical and bacteriological contamination in carbonate-rock aquifers. Fecal coliform bacteria, including Escherichia coli (E. coli), and nitrate contamination of groundwater from surface application of liquid manure has occurred several times over the past few years in Genesee County—most recently in early spring of 2010.
                            Carbonate-rock aquifers in western and central New York also have been contaminated by septic waste and improper chemical disposal and spills, such as the trichloroethylene (TCE) spill in eastern Genesee County (USEPA-http://www.epa.gov/region02/superfund/npl/0203481c.pdf, accessed March 2009).

                              Q: Drums (editor's note: part of the question was why are the barrels labeled "Hazardous Material" if they only contain dirt and rock that isn't hazardous.)

                              There are drums on the Lehigh Valley Derailment Superfund site. In terms of the drums, they contain dirt and rock from when wells were dug to monitor groundwater at the site both under NYS DEC's investigation and more recently under EPA's. As part of the ongoing cleanup, EPA is taking steps to get these drums sampled and removed from the site as soon as possible.

                              There is a contractor for the potentially responsible party. (PRP means the entity liable for paying for the cleanup of a Superfund Site.) A subcontractor is currently handling the drum consolidation and the transportation to a licensed facility under EPA oversight."

                                That's very interesting research, Digger. Apparently someone who had good knowledge of how contaminants distribute could take a lot of samples and yet avoid the contamination. There's some info here about that:

                                Rumor: The school district turned down an offer of free property for a new school and purchased the current property from the brother of a school board member. Mostly true.
                                I was wondering why the EPA can't sample the Le Roy school property, especially those athletic fields? I ran across this local article from a few years ago about a TCE case they were investigating and they might be able to do so. (To be clear, I think they should test for more than TCE. I would hope for pesticide and heavy metal testing, too, at the very least.)
