TOKYO (Kyodo) -- The Tokyo High Court on Tuesday overturned a lower court ruling that ordered the Japanese government and the Japanese unit of British drugmaker AstraZeneca PLC to pay damages to plaintiffs over side effects caused by the lung cancer drug Iressa.

In the lawsuit over side effects caused by the lung cancer drug Iressa, the Tokyo High Court completely overturned the lower court ruling holding both the government and the Japanese unit of British drugmaker AstraZeneca PLC responsible for the drug-induced side effects, rejecting appeals made by relatives of victims who died from the side effects.

No fund for anticancer drug claims?

In the wake of Tuesday's high court ruling finding the state and a drugmaker not liable over deaths caused by side effects of the lung cancer drug Iressa, the health ministry and concerned parties are likely to be cautious in expanding the scope of a compensation program for people suffering from drugs side effects.

Plaintiffs appeal high court ruling over cancer drug Iressa

TOKYO (Kyodo) -- Plaintiffs filed an appeal with the Supreme Court on Thursday against a recent high court decision that denied liability on the part of the Japanese government and the Japanese unit of British drugmaker AstraZeneca PLC in connection with fatal side effects related to cancer drug Iressa.
